If you are denied disability insurance and your request for reconsideration is also denied, you have 60 days from the second denial to request a hearing with an administrative law judge (ALJ). This judge will have had nothing to do with your case beforehand.
Although you may not have a hearing for some time, when the hearing does come around experts will be present. The administrative law judge and your attorney will have the opportunity to question the experts. Experts can be doctors, vocational specialists, employers or coworkers who can attest to your case.
It takes an average of 2 years to receive a date for a hearing. In the meantime, you will be assigned a case manager as your point of contact while your case is built. There are several things you can do that will greatly help to strengthen your case. You will want to communicate these things to your case manager for your file.
